RE: Forfeiture of Retirement Allowance for Dereliction of Duty by Members

DATE: November 5, 2025

As you are aware, under G.L. c. 32, § 15, a member who is charged with misappropriation of funds or is convicted of an offense related to funds of the governmental unit/system, or is convicted of certain enumerated crimes or crimes related to the laws applicable to his/her office or position, may lose the right to his/her retirement allowance and/or accumulated total deductions.

Attached please find updated lists of all public employees who are no longer statutorily eligible to join a Chapter 32 retirement system. Please review the attached lists (one sorted alphabetically by last name and one alphabetically by board name) and notify the Commission of any updates or discrepancies, along with supporting documentation.

If any of the forfeited members named on these lists are active in your system, please contact Doreen Duane at (617) 666-4446, extension 954 or doreen.m.duane@mass.gov, and identify your respective member's full name and last four of their Social Security number. Thereafter, Doreen will notify you whether that member is the same member who was forfeited.
