RE: Proposed Amendment to the Standard Rules for Disclosure of Information Regulations 840 CMR 6.00

The Commission has recently filed amendments to 840 CMR 6.00, Standard Rules for Disclosure of Information. The amendments clarify outdated terminology and ensure that the regulations comply with the Public Records Law, the Fair Information Practices Act, and associated regulations. The most significant of these amendments are noted below.

840 CMR 6.05, Notice and Report to the Public Employee Retirement Administration Commission, has been deleted and is now reserved for future use.

840 CMR 6.08, Access to Retirement Files by Employers, has been amended to require the written consent of a member before a retirement file can be provided to that member's employer.

840 CMR 6.13, Advisory Opinions, is now titled Contacting the Public Records Division. This regulation recommends that a Retirement Board seeking advice on the application of the Public Records Law contact the Public Records Division via phone or email, rather than seeking a formal advisory opinion.

PERAC will hold a remote hearing on the proposed amendments to 840 CMR 6.00 on Thursday May 21, 2026, at 10 a.m. Directions to access the hearing can be located at PERAC's website http://www.mass.gov/perac.
